How to Check an AI Case Citation | Legal Research for Students

Check an AI legal citation in four stages: source identity, support for the claim, context and currency. Includes a student self-check.

Jump to a chapter

Put the method into practice

  • A located source may still be the wrong source.
  • A real source may not support the stated claim.
  • Investigate later treatment, relevant legislation and context.
V06 / AI CITATION CHECKING

Finding a source is only the first check.

Your search locates the case name an AI mentioned. Does this establish that the case supports the AI's legal claim? What if a free collection returns no result?

Read the answer and rationale

No. Match the full reference, open the primary source and compare the relevant passage with the exact claim. Check the speaker, context, jurisdiction, later treatment and relevant legislation. A free collection may have incomplete coverage: “not found here” does not prove nonexistence. Try appropriate library resources and ask the law librarian.

An AI answer gives you a confident legal claim and a case citation. That is a research lead, not proof. Before you rely on it, separate four questions: does the source exist, is it the right source, does it support the claim, and is the proposition still usable for your task?

First, respect the rules for the work you are doing. If your assessment does not permit AI assistance, an accurate citation would not make that assistance permitted. Do not upload restricted course material or private documents merely to test a tool.

For this demonstration, our screen uses an obvious placeholder labelled 'unverified example'. We are not inventing a real-looking citation for you to copy. Take the actual reference you need to check and search an appropriate official or library source. Compare the party names, court, year and reference, rather than choosing the first similar result.

If a free search finds nothing, do not immediately conclude the case is fabricated. Free collections have coverage limits. Try the resources available through your university library, or ask the law librarian. Equally, do not treat repeated appearances on AI-written websites as independent verification.

Second, open the judgment or other required primary source. A real case can still be cited for something it never decided. Find the relevant passage and read enough surrounding reasoning to understand its scope. Check whether you are looking at a party's submission, background, a dissent or the court's own reasoning.

Third, compare that passage with the AI's precise claim. Does it support the whole claim, a narrower proposition, or something else? Record the source and passage reference in your own notes. If you cannot make the connection, do not quietly copy the sentence into your work.

Fourth, check later treatment and any relevant legislative change using suitable research tools. A database warning is a prompt to investigate, not an automatic answer. Read the later material and record when you checked. Jurisdiction and the question you are answering still matter.

Now your self-check: finding the case name confirms that the source exists. Does it also confirm the AI's proposition? No. That requires reading and comparing the source. Those are different checks.

When verification remains incomplete, state the limit and ask for help. Do not invent the missing authority. Use AI to raise questions where permitted, then let the sources and your own reasoning do the work. The free verification and research guides are linked below.
