Law Dissertation Methods: Match Evidence to Question

Law Dissertation Methods: Match Evidence to Question. A worked example, self-check and independent sources for UK law students.

Try the method

Can a policy text alone show how every user experiences it?

Compare your answer

No. Revise the question or develop an appropriate approved evidence plan.

  • What do you need to know?
  • What could establish it?
  • Analysis / feasibility / ethics

Extended reading: use the method

Let the question control the evidence

A method should explain how the evidence will help answer your question. Doctrinal research often examines legal rules, principles and relationships through authorities. Socio-legal research investigates law in context and can use empirical, theoretical or documentary approaches. These broad distinctions are not an exhaustive classification or a UK-wide dissertation template.

Test a mismatch with a fictional example

Our original practice proposal asks how users experience an invented appeals procedure. Its plan is only to summarise the written policy. The policy can support an account of the stated design. It does not alone establish users' experiences. The example is a planning exercise, not a real research project or legal authority.

Discuss two defensible options

One option is to narrow the question to the policy's design or interpretation. Another is to investigate experience using an appropriate evidence plan. Discuss access, time, training, analysis and any ethics or permission requirements with your programme before collecting material. Combining approaches may fit some questions, but adding interviews merely to sound ambitious is not a justification.

Prepare one page for your supervisor

Write your question, contribution, evidence, method, main limitation and two decisions you need help making. Keep a literature map and a search log behind it. The cited historical Oxford methods guide supports conceptual orientation only; check your own current handbook for actual requirements. Neither a method label nor an impressive-looking source list guarantees a mark.

Sources and further reading

Use the original guidance alongside your course instructions. A source collection may have gaps; ask your law librarian if you cannot find an authority.

What the video says

A dissertation method should fit the question. Doctrinal work often analyses legal rules and authorities. Socio-legal work explores law in social context and may use empirical, theoretical or documentary methods. These are broad approaches, not an exhaustive menu. A policy text can show stated procedures; it cannot alone establish users' experiences. Discuss feasibility and any ethics approval before involving people or collecting identifiable data. Quick check. Can a policy text alone show how every user experiences it? No. Revise the question or develop an appropriate approved evidence plan.
